HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12327 of 2015 ORDER:

This petition is filed by the petitioner - Accused No.1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.164 of 2015 on the file of Bommuru Police Station, Rajahmundry Urban, East Godavari District for the offences punishable under Sections 8(c) r/w.20(b)(ii)(C) of NDPS Act. Heard and perused the material available on record. The allegation against the petitioner is that he is found in possession of 375 kgs., of ganja.

The earlier bail application, filed by the petitioner, was dismissed by this Court on 29.10.2015. Now, the learned counsel for the petitioner submitted that the petitioner is suffering with HIV and hence, he may be granted bail. This Court is of the view that it is not a ground to consider the bail application of the petitioner. Hence, this Court is not inclined to grant bail to the petitioner.
