THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9383 of 2015 ORDER:

1. This petition is filed by the petitioners-A4 and A5 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in C.C.No.322 of 2012 on the file of the II Additional Chief Metropolitan Magistrate, Vijayawada.

2. Heard and perused the material available on record.

3. The material on record goes to show that earlier, anticipatory bail was granted to the 1st petitioner. The 2nd petitioner filed Criminal Petition under Section 482 Cr.P.C. seeking to quash the proceedings against them in the above C.C. and this Court dismissed the said Criminal Petition granting liberty to the 2nd petitioner to file an application under Section 205 Cr.P.C. before the learned Magistrate and directing the trial Court to dispose of the C.C. as expeditiously as possible.

It is apparent that NBWs are pending against the petitioners. But the petitioners never informed this Court that NBWs are pending against them. After obtaining the order in the quash petition, the present petition is filed by the petitioners. This Court is not inclined to grant anticipatory bail to the petitioners.
