HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23396 of 2018 ORDER:
Heard counsel for petitioner and the learned Assistant Government Pleader for respondents 1 to 4.
The petitioner challenges the order dated 20.12.2017 of 4th respondent incorporating the name of 5th respondent in adangal as illegal, arbitrary and unconstitutional.
The Assistant Government Pleader submits that the petitioner can effectively challenge the impugned proceedings before the 3rd respondent by filing appeal and the appellate authority will have opportunity of examining entire record and correcting the entries, as are found to be necessary.
Prima facie, I am of the view that the petitioner can be relegated to the remedy of appeal/ representation before 3rd respondent.
Hence, the writ petition is disposed of by this order. (a) The petitioner is given liberty to file appeal within four weeks from today by enclosing a copy of this order.
(b) The 3rd respondent is directed to consider and dispose of the appeal within two months thereafter. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
