THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33849 OF 2016 ORDER:
This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the proceedings No.C/10049/2016, dated 9.9.2016, and consequential memo No.C/10046/2016, dated 19.9.2016, issued by respondent No.6 and non-granting of permission to the petitioner Society by respondent Nos.2, 6 and 7 for erecting temporary shed for installation of Goddess Durgamatha idol for performing Durga Navarathrula Utsavalu adjacent to Trishakti Temple of Korutla Town during the Dasara Navarathris from 1.10.2016 to 12.10.2016, when already respondent no.3 granted permission for use of mike for conducting Durga Navarathrula Utsavalu in favour of the petitioner society from 1.10.2016 to 12.10.2016 by considering the applications submitted by the petitioner, dated 12.9.2016 and 17.9.
2016, as illegal and arbitrary and consequently, to direct respondents Nos.2, 6 and 7 to grant permission for erecting temporary shed for installing Goddess Durgamatha idol for performing the Durga Navarathrula Utsavalu during Dasara Navarathris adjacent to Trishakti Alayam, Korutla by considering the applications submitted by the petitioner, dated 12.9.2016 and 17.9.2016.

Heard and perused the material available on record. 3.
Learned counsel for the petitioner Society submitted before this Court that nothing survives for adjudication in this writ petition in connection with installation of Goddess Durgamatha
idol in the place where the petitioner Society intends to install the same.

Considering all the facts and circumstances of the case, this Court is of the view that as respondent No.6 passed a preliminary order on 9.9.2016 invoking the provision under Section 145 Cr.P.C. even though there is no failure of law and order in the said area, the petitioner Society is at liberty to approach the appropriate Forum challenging the said order. 5.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
