HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.110 OF 2016 ORDER:

This application is filed to withdraw F.C.O.P.No.2 of 2016 from Family Court, Karimnagar and transfer the same to Family Court, Warangal.

Wife filed this application.

According to her affidavit, her marriage was solemnized on 24-2-2007 at her parents house and during their wedlock, two children were born. She stated that respondent instituted O.P. before Family Court, Karimnagar for restitution of conjugal rights and distance between Karimnagar and Warangal is 90 K.M. she stated that she is residing with her children and parents at her parents house and it is difficult for her to travel from Karimnagar along with children. She further stated that respondent is physically fit and financially sound to travel from Karimnagar to Warangal. For these reasons, she prayed to transfer O.P. from Family Court Karimnagar to Family Court, Warangal.

This court permitted the petitioner to take personal notice through registered post with acknowledgment due and in compliance of the said order, advocate filed memo along with postal acknowledgment stating that notice was duly served on respondent on 29-2-2016. In spite of

service of notice, respondent neither appeared in person nor through any advocate.

Heard both sides.

Considering the reasons stated in the affidavit and also considering the convenience of petitioner, F.C.O.P. No.2 of 2016 is withdrawn from Family Court, Karimnagar and transferred to Family Court, Warangal for disposal in accordance with law.

Petition is ordered accordingly. No costs.

As a sequel to the disposal of this petition, Miscellaneous Petitions, if any, pending, shall stand dismissed.
