THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8286 of 2004 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Certiorari and quash the impugned proceedings No.PA/581(1)/03-DVM-NZB, dated 23-4-2004 as arbitrary, unjust and in violation of Art. 14, 16 and 21 of the Constitution of India and grant all consequential benefits.

2. The learned counsel for both the parties submitted that the petitioner retired from service on attaining the age of superannuation. They further submitted that in view of the death of the petitioner, no cause of action survives in this writ petition.
