This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.29 of 2017 on the file of Judicial Magistrate of First class, Parchur. At the time of hearing, the learned counsel for the petitioners submitted that petitioner No.1/accused No.1 will attend the trial court and the only relief, that he is seeking in the present petition, is to dispense with the presence of petitioners 2 and 3 who are accused 2 and 3, during trial. Heard the learned Public Prosecutor for the State of Andhra Pradesh. In view of the submission made by the learned counsel, this court is not inclined to go into the merits of the main case. There is no dispute with regard to identity of petitioners/ A-2 and A-3. Even if their presence is dispensed with, no prejudice would be caused to the 2nd respondent.
Having regard to the facts and circumstances, the presence of the petitioners 2 and 3 / A-2 and A-3 in C.C.No.29 of 2017 on the file of Judicial Magistrate of First class, Parchur, is dispensed with on each and every date of hearing. However, they shall appear before the trial court as and when their presence is required.
