HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 8954 of 2021 O R D E R:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused seeking bail in the event of his arrest in connection with Crime No.416 of 2021 on the file of Jagtial Rural Police Station, Jagtial District, registered for the offences punishable under Sections 452, 307 and 506 IPC.

The case of prosecution is that on 30.08.2021 at 9.30 hours, the accused, with an intention to kill the de-facto complainant due to previous enmity, has criminally trespassed into his house and attacked with a button knife on him resulting bleeding injuries on his right hand and also threatened him with dire consequences.

Learned counsel for petitioner Sri G. Rajeshwar Reddy, submits that the de-facto complainant is a Ward Counsellor and in view of political differences between the petitioner and the de-facto complainant, a false case has been foisted against the petitioner. Learned counsel submits that even as per the doctor's report, injuries sustained by the de-facto complainant are simple in nature. He submits that petitioner has requested the de-facto complainant on many occasions to release the amounts, and in that regard, when he went to the de-facto complainant, the present case is foisted against him. He submits that the petitioner is unconnected with the alleged offence, hence, his case may be considered for grant of pre-arrest bail.

On the other hand, learned Assistant Public Prosecutor submits that as per the doctor's report, the de-facto complainant has sustained simple injuries.

Taking into consideration the fact that the injuries sustained by the de-facto complainant are simple in nature and political differences are alleged between the parties, this Court deems it appropriate to grant prearrest bail to petitioner. 6.

The Criminal Petition is allowed. Petitioner - Accused shall surrender before the Station House Officer, Jagtial Rural Police Station, Jagtial District, in connection with Crime No.416 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. It is made clear that no further extension of time will be granted.
