THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9572 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.238 of 2022 on the file of Tandur Police Station, Vikarabad District, registered for the offences under Section 307 and 353 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The allegation of the prosecution is that this petitioner and another were found in suspicious circumstances and the Police tried to stop them. However, this petitioner pushed the de-facto complainant, who is a Constable and ran away. Having chased the petitioner, the de-facto complainant tried to apprehend him, the petitioner took out the knife and tried to stab him.

Learned Additional Public Prosecutor on instructions would submit that charge sheet is already filed and A-2 was released on bail.

Since the investigation is complete, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties i.e., on local surety and the other from the native place, for a like sum each to the satisfaction of Judicial First Class Magistrate, Tandur, Vikarabad District.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
