HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.45890 of 2016 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the action of respondents in insisting the petitioner/respondent No.2 to appear each and every adjournment in Crl.A.(DVC) No.293 of 2016 on the file of the III Metropolitan Sessions Judge at Nampally otherwise Non Bailable Warrant will be issued, as illegal and arbitrary and consequently direct respondents not to insist the petitioner to attend each and every adjournment.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record. Considering the facts and circumstances of the case and the nature of allegations wherein the question of identity of petitioner does not arise, presence of the petitioner on each and every hearing before the III Metropolitan Sessions Judge, Nampally is dispensed with, but he shall appear before the Sessions Judge when the Sessions Judge insists for his appearance for any specific purpose.
