THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.25774 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, praying for the following relief:

"To call for records relating to the proceedings of the 2nd Respondent vide Lr. No. 489 / SAND / DLIS / DIV. NO.1/ 2017, dated 23-05-2017 and set aside the same as illegal and contrary to law and in consequence thereof, direct the Respondents not to excavate the sand from the villages of Koratikal, Kamsanpally and Tirumalapuram of Uppununthala Mandal, Nagarkurnool District under the guise of an impugned order as issued by the 2n Respondent more particularly by way of Writ of Mandamus".

A counter affidavit deposed by Executive Engineer-DILIS-I, Dindi, Nalgonda district-7th respondent herein is filed and paragraph 10 of the said counter reads as under:

"It is submitted that the lifting of sand in the above quarry has been done upto a depth of 15 feet only as per orders i.e. in the foreshore area of the Dindi Medium Irrigation Project, which will not effect on bore wells and other agriculture works of adjacent villages. It is also brought to the notice that the sand quantity of about 1,00,000 cubic metres, which was allotted by the District Collector, Nalgonda has been lifted and now the lifting of sand from the above quarry was stopped. Further balance quantity of sand will be lifted after starting of main canal works, duly obtaining proper permission from the District Collector, Nalgonda".

In view of the same, this writ petition is closed by placing the above averments on record. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 23.10.2017 DA
