THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.5846 OF 2015 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The matter is taken up under the caption 'for being mentioned' as it was erroneously allowed on 27.08.2018 under the impression that it was covered by an earlier order passed by this Court. However, perusal of the order under challenge reflects that no relief was granted by the Andhra Pradesh Administrative Tribunal (hereinafter, 'the Tribunal'), Hyderabad, in O.A.No.6014 of 2013 to the effect that the applicant therein, the first respondent in this writ petition, should be given reappointment as a Home Guard.

On the other hand, all that the Tribunal granted was liberty to the first respondent-applicant to make a representation to the authorities with regard to his willingness to work as a Home Guard within a time frame and the authorities were directed to pass appropriate orders on such representation within a time frame. This being the import of the order passed by the Tribunal, we are at a loss to understand as to why the State was aggrieved thereby to the extent that it filed this writ petition and secured interim suspension of the said order.

We therefore dismiss the writ petition leaving it open to the authorities to pass appropriate orders upon the representation filed by the first respondent-applicant. Such representation shall be made within fifteen days from the date of receipt of a copy of this order. Consideration thereof in terms of the order passed by the Tribunal shall be within eight weeks from the date of its receipt.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
