THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD ORDER:

This writ petition has been filed questioning inaction on the part of the official respondents 2 to 5 in taking action against the unofficial respondents 6 and 7, who are making illegal constructions violating the status quo orders granted by the Court in I.A. No.361 of 2018 in O.S. No.700 of 2018 in respect of the Plot Nos.634 and 635, Type B admeasuring 400 Sq.Yds., in Sy.No.204 and I.A.

No.1156 of in O.S. No.1992 of 2016 in respect of the Plot Nos.616 and 617, Type B admeasuring 400 Sq.Yds., in Sy.No.204 situated at Sriram Nagar, Kondapur Village, Serilingampally Mandal, Ranga Reddy District and consequently to direct the respondents 2 to 5 to demolish the illegal structures made by the unofficial respondents 6 and 7.

The learned counsel for the petitioner submitted that though the petitioner made a representation dated 02.11.2019 to the official respondents bringing to the notice that the unofficial respondents 6 and 7 raised illegal structures over the subject land without obtaining any permission from the competent authority, no action has been initiated by the authorities.

TA, J The learned standing counsel, Sri Sampath Prabhakar Reddy, appearing for GHMC, submitted that unofficial respondents 6 and 7 have grossly violated the order of status quo passed by the learned trial Court and the authorities are already on the way to take appropriate action against the unofficial respondents 6 and 7.

Heard the learned counsel on either side and perused the material placed on record.

The main grievance of the petitioner is that the unofficial respondents 6 and 7 raised unauthorized structures over the subject land by violating the order of status quo granted by the learned trial Court as stated hereinabove. Even in spite of representation made by the petitioner, bringing all the said facts to the notice of the official respondents 2 to 5 on 02.11.2019, no action has been initiated by the authorities to remove the illegal structures nor was any notice issued to the unofficial respondents to remove the said illegal structures. In that view of the matter, this writ petition is disposed of with the following direction.

The third respondent, Deputy Commissioner, GHMC, Circle No.11, is directed to take appropriate action on the representation dated 02.11.2019, stated to have been made by the petitioner, and pass appropriate orders, in accordance with law, after affording opportunity to the petitioner as well

TA, J as to the unofficial respondents 6 and 7, as expeditiously as possibly.

Accordingly, this writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
