Heard learned counsel for the petitioners and learned Government Pleader for Education.
Learned counsel for the petitioners submitted that in similar circumstances, this Court disposed of W.P.No.22120 of 2014 & batch, through order, dated 05.09.2014 and the same is not disputed by the learned Government Pleader.
Following the same, this writ petition is also disposed of, directing that as per the scheme laid out in G.O.Ms.No.94, Education (SE-PROG-I) Department, dated 25.11.2002 the necessary procedure be followed for replacing such of those agencies against whom allegations have been received. However, if any of the petitioners are continuing as mid-day meals providers as of today, they shall be continued, but the summary enquiry shall be conducted in their presence. Based upon the outcome of the enquiry, appropriate action either for retention or for taking them out can be taken. An order in that regard shall be passed and communicated to them. Wherever a new agency has already been picked up in place of any of the petitioners, the same shall be allowed to continue till the outcome of the enquiry is made known. There shall be no order as to costs.
