THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.25753 OF 2006 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking verbatim the following relief: "to issue an appropriate writ, order or direction, particularly in the nature of writ of mandamus, by declaring the inaction of the 4th respondent in not recovering the amounts due to the petitioner, u/s.31 of W.C.Act, from respondents 1 to 3, as illegal and arbitrary and consequently direct the 4th respondent to recover the balance of the amount excluding Rs.1,40,000/- out of Rs.1,00,830/- with 12% interest per annum, from respondents 1 to 3 and pay it to the petitioner."

At the hearing, learned counsel for the petitioner and the learned counsel appearing for the 2nd respondent submitted that as per the settlement outside the Court, the petitioner received a sum of Rs.73,820/- (Rupees seventy three thousand eight hundred and twenty only) vide Demand Draft bearing No.819957, dated 07.02.2012, drawn on State Bank of Hyderabad, Vizag Brach towards full and final settlement of her claim vide award in W.C.No.252/89, A.S.No.78/2002, W.P.No.25753/2006 and H.R.C.No.9904/2010 and issued a receipt acknowledging the said payment and stating that she has no further claims against the respondents and that in that view of the matter, no cause survives for adjudication in this writ petition.

Recording the submissions, the Writ Petition is dismissed as infructuous.
