Heard.

The petitioner seeks a direction against the 4th respondent not to insist the presence of the petitioner at the police station as no criminal case is registered against him.

Learned Government Pleader has received instructions, which state that the petitioner was found involved in Cr.No.300 of 2014 for the offence under Section 20(b) of N.D.P.S. Act, which is subject matter of S.C.No.492 of 2014 before the I Additional District Judge, Anantapur. The petitioner was released on bail vide order of this Court in Crl.P.No.12318 of 2014, dated 01-10-2014. It is also stated that on 22-12-2014, the petitioner and others were found indulged in game of chance by betting money and playing makta and accordingly, Petty Case Nos.699 to 706 of 2014 are registered against the petitioner and others for the offence under Section 9(1) of the A.P.Gaming Act on 2212-2014. Hence, the petitioner and others are required to present before the Investigating Officer so as to process the said petty cases.

Obviously, the contention of the petitioner that no case is pending against him is incorrect. Since the petty cases are registered against him and others on 22-12-2014, the petitioner is required to appear before the Investigating Officer, so that the said petty cases can be processed further.

Hence, the writ petition is disposed of directing the petitioner to appear before the Investigating Officer/3rd respondent, who shall thereafter process the said petty cases and pass appropriate orders thereon in accordance with law. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
