THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.2706 of 2015 ORDER :

The petitioner preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 18-09-2015 passed in Crl.M.P.No.1132 of 2015 in C.C.No.73 of 2013 by the Additional Junior Civil Magistrate at Bheemunipatnam, Visakhapatnam, wherein and whereby the learned Magistrate dismissed the discharge petition filed by the petitioner herein invoking the provisions under Section 239 Cr.P.C.

2. Heard and perused.

3. After arguing for some time, the learned counsel for the petitioner confined his argument and prayed to dispense with the presence of the petitioner before the trial Court.

4. Considering the facts and circumstances of the case, the presence of the petitioner is dispensed with before the concerned Court, except on the dates on which the trial Judge insists for his appearance. Apart from that, the petitioner is directed to appear before the concerned court (i) to answer the charge;

and (ii) to answer examination under Section 313 Cr.P.C.

5. Accordingly, the Criminal Revision Case is disposed of.

6. Miscellaneous petitions filed in this revision, if any, shall stand closed.
