The petitioner, who claims to have obtained
building permission in 1994, filed this Writ Petition feeling aggrieved by the action of respondent No.4 in interfering with the activity of carrying on repairs to her house, which is, allegedly, in existence. The petitioner has filed photographs, from which it is clearly evident that no house is in existence as claimed by her, but, a purely temporary structure appears to have been recently erected with a few pillars and a slanted tinned roof without side walls. By any standards, the said structure cannot be described as a building.
Therefore, any additions and alterations to such a structure cannot be termed as mere repairs. If a building permission was obtained by the petitioner as claimed by her in 1994, its validity has expired long back. Unless a fresh permission is obtained by her, she cannot raise any construction in the name of repairs and complain of interference by respondent No.4. In this view of the matter, I am not inclined to entertain this Writ Petition. However, the petitioner is permitted to make a fresh application for building permission.
Subject to the above observations, the Writ Petition is dismissed.
