When the matter is taken up for hearing, it is noticed that the Writ Petition against the 1st respondent was dismissed for default on 23.06.2011 and thereafter, the petitioner has not taken any steps to ensure that the Writ Petition against the 1st respondent is restored. The petitioner is challenging the orders passed by the Industrial Tribunal in ID No.87 of 2001, dated 15.11.2003, in so far as denying back wages and attendant benefits, and imposing a minor penalty of deferment of one annual grade increment with cumulative effect. The petitioner is seeking the relief against the 1st respondent and, in the absence of 1st respondent, the relief sought by the petitioner cannot be granted.

Accordingly, Writ Petition is dismissed.
