HONOURABLE SRI JUSTICE P. KESHAVA RAO Writ Petition No. 820 of 2015 ORDER:

The prayer sought in the writ petition is as under: "For the reasons stated in the accompanying affidavit, it is prayed that the Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus to declare the inaction of the respondent No. 3 herein in investigating into Cr.No. 698/2013, though the said crime is registered on 21122013, as illegal, arbitrary and unconstitutional and consequently direct the respondent-police to complete the investigation and to lay the charge sheet before the concerned Magistrate in accordance with Law and to grant such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case." 2.

During the course of hearing, the learned Government Pleader placed on record the written instructions dated 02.02.2015 submitted to the office of the Government Pleader and the same are made as part of the record.

A perusal of the written instructions would reveal that after a full-fledged investigation, proposals were submitted to the Commissioner of Police, Cyberabad to accord permission to refer the complaint of the petitioner as 'lack of evidence'. In fact, the averments made in the affidavit filed in support of the writ petition are the subject matter of the investigation in Cr.No.698 of 2013 for which a detailed investigation is completed and final report will be filed before the concerned Court after obtaining the permission from the higher authorities by following the due procedure of law.

In view of the same, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. There shall be no order as to costs.
