This writ petition is filed challenging the proceedings in Letter No.R.O (O.B) 600, dated 22.10.2008 wherein the sale deed presented by the petitioners was refused by the 1st respondent vide refusal order No.37 of 1999 for want of ULC permission. There is also an observation in the said letter that if the document is not taken within 15 days, the same will be destroyed as per rules.
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
Learned counsel for the petitioners submit that in view of the refusal order No.37 of 1999, the petitioner may be permitted to avail alternate remedy of appeal under Section 72 of the Registration Act, 1908.
In view of the submission of the learned counsel for the petitioners, without going into the validity or otherwise of the order of the 1st respondent, this writ petition is disposed of granting liberty to the petitioners to avail alternate remedy of appeal against the order of refusal No.37 of 1999 under Section 72 of the Registration Act, 1908.
It is stated that the refusal order No.37 of 1999 was not communicated to the petitioners. It is open for the petitioners to collect the document from the 1st respondent, if not already collected, within a period of three weeks from today.
There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand dismissed. ____________________________ A.RAJASHEKER REDDY, J 06.01.2017 kvs
