THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39657 OF 2016 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue. With consent of both parties, the Writ Petition is disposed of at the admission stage itself.

2. The present Writ Petition came to be filed with the following prayer:

"... to issue order direction more particularly one in the nature of writ of MANDAMUS declare the action of the respondents in not considering the application filed by the petitioner on 16.08.2016 for conducting survey and fix the boundaries of the agricultural land covered in RS No.45/1 an extent of Ac.3.00 Cts, situated at Kandrikagudem Village, Buttaigudem Mandal, West Godavari District as illegal arbitrary and contrary to the provisions of A.P.Survey and Boundaries Act and consequentially direct the 3rd respondent to conduct survey and fix the boundaries in the land covered in RS No.45/1 an extent of Ac.3.00 Cts, situated at Kandrikagudem Village, Buttaigudem Mandal, West Godavari District and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."

Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent No.3 - Tahsildar, Buttaigudem Mandal, Buttaigudem, West Godavari District, to conduct survey of the subject land. He further submits that the petitioner made an application on

CPK,J W.P.No.39657 of 2016 16.08.2016 for conducting survey of the subject land, but till date, no survey has been done.

4. Learned Government Pleader for Revenue submits that if the said application filed by the petitioner is still pending consideration, respondent No.3 may be directed to consider the same.

5. Having regard to the above submissions made and without going into the merits of the case, the Writ Petition is disposed of directing respondent No.3, - Tahsildar, Buttaigudem Mandal, Buttaigudem, West Godavari District, to dispose of the application, dated 16.08.2016, made by the petitioner seeking survey of the subject land, if it is in order, in accordance with law, as early as possible, preferably within a period of six (6) weeks from today.
