HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.283 of 2016 ORDER:

This petition is filed to withdraw O.P.No.21 of 2016 from the file of Principal Senior Civil Judge at Rajahmundry, East Godavari District, and transfer the same to Family Court, Ranga Reddy District at L.B.Nagar.

2. Wife filed this application. According to her affidavit, her marriage with respondent was performed on 11.05.2014 at Rajahmundry as per Hindu rites and caste custom and immediately after marriage, she joined respondent at Peddapuram and thereafter respondent started harassing and she tolerated the harassment for about two years without intimating her parents, but having observed by her brother, she informed the harassment to her parents and finally she was necked out from her inlaws house on 22.12.2014, as she has no other go she went to her parents house and that respondent intentionally filed O.P. before Principal Senior Civil Judge, Rajahmundry to harass her. She stated that she gave a police complaint and charge sheet was also filed before XV Metropolitan Magistrate, Medchal, Cyberabad against respondent and his mother for the offence under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act. She stated that respondent is doing private job at Hyderabad and to harass her O.P. is filed in East

Godavari District, therefore, the same has to be transferred to Family Court, Ranga Reddy at L.B.Nagar.

3. Respondent did not file any counter disputing the affidavit averments of petitioner.

4. When this matter was taken up on 05.07.2016, there was no representation for respondent in spite of that the matter is adjourned by three weeks to enable respondent to file counter. Today when this matter is taken up, neither advocate for respondent present nor any representation is made.

5. Heard arguments.

6. As seen from the affidavit of petitioner, both respondent and petitioner are residing at Hyderabad and O.P. is filed before Senior Civil Judge, Rajahmundry as respondent is native of Peddaparum of East Godavari District.

7. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.21 of 2016 is withdrawn from Principal Senior Civil Judge at Rajahmundty, East Godavari District and transferred to Family Court, Ranga Reddy District, for disposal in accordance with law.

8. Accordingly, transfer C.M.P. is ordered.

9. Miscellaneous petitions pending, if any, shall stand closed.
