THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.26749 OF 2019 ORDER:

This Writ Petition is disposed of at the admission stage with the consent of both the parties.

This Writ Petition is filed seeking writ of mandamus to declare that the petitioner is entitled to be selected to the post of SCTPC (TSSP) (Men), Post Code 24, in pursuance to the notification in Rc.No.88/ Rect/ Admn.I/ 2018 dated 31.05.2018 and sought a consequential direction to select the petitioner to the post of SCTPC (TSSP) (Men), post Code 24, along with other candidates.

Heard Sri S. Surender Reddy, learned counsel appearing for the petitioner and Sri M. V. Rama Rao, learned Standing Counsel for R-2.

It has been contended by the counsel for the petitioner that the petitioner is fully eligible and qualified for appointment to the post of SCTPC (TSSP) (Men), Post Code 24. In pursuance to the notification in Rc .No.88/ Rect/ Admn.I/ 2018 dated 31.05.2018, the petitioner had responded and participated in the selection process. The petitioner was declared to have secured 94.75 marks. The case of the petitioner was not considered for appointment to the post of SCTPC (TSSP) (Men). He further contended that there are still 82 vacancies not shown in the provisional selection list and the petitioner is the eligible candidate for the post of SCTPC (TSSP) (Men) in the unfilled vacancies and hence, the case of the petitioner can be

considered by the respondents in the resultant vacancies. Though a representation was filed by the petitioner to that effect, the respondents have not considered the case of the petitioner. Therefore, counsel for the petitioner contends that appropriate orders be passed directing the respondents to consider the case of the petitioner for appointment to the post of SCTPC (TSSP) (Men).

Sri M. V. Rama Rao, learned Standing Counsel appearing for the second respondent, would categorically state that the case of the petitioner would be considered if only the petitioner files a representation afresh seeking appointment to the post of SCTPC (TSSP) (Men) and appropriate orders would be passed in accordance with law.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the petitioner to submit a representation afresh to the respondents within two (2) weeks from the date of receipt of a copy of this order seeking appointment to the post of SCTPC (TSSP) (Men). Upon receipt of such representation, the respondents shall consider the same and pass appropriate orders in accordance with law within six (6) weeks thereafter. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
