HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.25050 2017 Date:01.9.2017 Between:

V.Suresh, S/o Govindaswamy ..... Petitioner And:

The District Educational Officer, Warangal District and three others.

.....Respondents Counsel for the petitioner: Mr. M.Ramgopal Rao Counsel for the respondents: GP for Services (TS) The Court made the following:

CVNR, J & GSP, J WP.No.25050 of 2017 Dated:01.9.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed feeling aggrieved by the inaction of the respondents in implementing order, dated 01.9.2016, in Original Application No.4382 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, (for short 'the Tribunal').

At the hearing, the learned Government Pleader for Services (Telangana) has placed before the Court proceedings, vide Proc.Rc.No.4382/B1/2015, dated 26.7.2017, of respondent No.1, wherein he has informed the petitioner that if his request for transfer is considered in the middle of the academic year, it will adversely affect the students; that transfers are to be effected through conselling only; and that the Government has issued orders imposing ban on transfers. He has further stated that the petitioner's request for transfer will be considered in the next ensuing transfer conselling.

While we find justification in the afore-mentioned stand taken by respondent No.1 for not considering the petitioner's request for transfer during the present academic year, we, however, feel that the petitioner's request needs to be considered for the next academic year in view of the peremptory direction issued by the Tribunal in the said O.A., irrespective of whether

CVNR, J & GSP, J WP.No.25050 of 2017 Dated:01.9.2017 general transfers will be undertaken for the next academic year or not.

Learned Government Pleader has submitted that respondent No.1 will consider the petitioner's request for transfer for the next academic year before the commencement of the same.

While placing on record this undertaking of the learned Government Pleader, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, WPMP.No.31059 of 2017 is disposed of as infructuous. __________________________ JUSTICE C.V.NAGARJUNA REDDY ____________________________ JUSTICE GUDISEVA SHYAM PRASAD 01st September 2017 DR
