THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9587 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.2 seeking bail in the event of his arrest in connection with Crime No.247 of 2023 on the file of Film Nagar Police Station, Hyderabad, registered for the offences under Sections 370, 370(A)(2) of IPC and Section 3, 4 and 5 of PIT Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Sub-Inspector of Police, P.S., Banajara Hills raided premises, which was named as 'Olive Lake Spa' at Plot No.C12, Road No.9, Film Nagar, Banjara Hills. At the time of inspection, they found that prostitution was being run in the said premises by engaging female sex workers. The Police found a female sex worker and also the customers in the said premises.

The petitioner is shown as absconding. According to the Police, he was shown as Manager of the Spa.

In the premises, the woman found was aged 24 years. 6.

Learned counsel for the petitioner would submit that the petitioner had nothing to do with the running of the Spa and it is in the name of another person.

The relief of anticipatory bail can be granted to this petitioner subject to conditions since he was not found in the premises:-

1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Film Nagar Police Station, Hyderabad, on 17.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.2 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
