This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not transferring the ownership (license) stands in the name of K.R.Patel, Proprietor Sri Shankar Vijay Saw Mill & Sri Rama Timber Depot, NH-5 Road, Aganampudi, Visakhapatnam, with existing machinery in favour of Mukesh Kumar Patel (legal heir of original licensee K.R.Patel) is illegal, arbitrary, violation of Articles 14 and 19 (1) (g) of the Constitution of India and contrary to the guidelines issued in G.O.Ms.No.91, dated 11.7.2006, and consequently, direct the 3rd respondent to transfer the ownership (license) stands in the name of K.R.Patel, Proprietor Sri Shankar Vijay Saw Mill & Sri Rama Timber Depot, NH-5 Road, Aganampudi, Visakhapatnam, with existing machinery in favour of Mukesh Kumar Patel."
When the matter is called, the learned Counsel for the petitioner submitted that for redressal of his grievance, the petitioner has submitted a representation to the 3rd respondent
AVSS, J W.P.No.12157 of 2017 Dt: 06.04.2017 on 06.03.2015 and requested that the said representation may be directed to be disposed of by fixing some timeframe. The above said request is not opposed by the learned Government Pleader for Forests (AP). He submitted that appropriate action will be taken, in accordance with law, on the said representation.
In view of the above, the Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter, by directing the 3rd respondent - Divisional Forest Officer, Visakhapatnam, to take appropriate action on the representation, dated 06.03.2015, said to have been submitted by the petitioner herein, within a period of four weeks from the date of receipt of a copy of this order, in accordance with law.
