HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24852 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the respondents in deleting the names of the petitioners from the existing list of eligible pensioners of Punugodu Gram Panchayat/Village, Kanigiri Mandal, Prakasam District and also inaction of the respondents to continue/restore the pension to the petitioners pursuant to the representation to the respondent Nos.2 to 4 as illegal, arbitrary, contrary to G.O.Ms.No.135, dated 17.9.2014 and violative of Articles, 14, 19 and 21 of Constitution of India and consequently direct the respondents to grant the social security pension to the petitioners retrospectively in terms of G.O. Ms.No.135, dated 17.9.2014.

2. Heard the learned counsel for the petitioners, learned Government Pleader for Panchayat Raj & Rural Development (A.P.) and the learned Standing Counsel for respondent Nos.4 to 7.

3. The case of the petitioners is that the petitioner used to get social security pension till 2014. As the petitioners were not getting pension, they approached the fourth respondent and other officials but of no use. Having no other alternative, the petitioners made a representation dated 04.7.2016 to the second respondent to grant pension.

4. The learned counsel for the petitioners submitted that the second respondent may be directed to dispose of the representation of the petitioner dated 04.7.2016.

5. Taking into consideration to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioners dated 04.7.2016, in the light of G.O.Ms.No.135, Panchayat Raj and Rural Development (RD.I)

Department, dated 17.9.2014, as early as possible preferably within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
