THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1490 OF 2015
ORDER:
1. This revision case is filed by the petitioner challenging the order dated 25.6.2015 in M.P.No.52 of 2014 in M.C.No.12 of 2012 on the file of the Family Court, Secunderabad.
2. The 2nd respondent is the wife and the 3rd respondent is the son of the petitioner. The 2nd respondent filed the above M.C. against the petitioner seeking to grant maintenance to her son at the rate of Rs.5,000/-p.m. On 7.2.2014, the petitioner was set ex parte in the above M.C. and subsequently, on 7.4.2014 ex parte decree was passed in the above M.C granting maintenance of Rs.4,000/- per month to the 3rd respondent. The petitioner filed the above M.P.No.52 of 2014 seeking to condone the delay of 4 days in filing the petition to set aside the ex parte decree. The trial Court allowed the above Crl.M.P. on condition of depositing 50% of the arrears of maintenance ordered on 7.4.2014 by 31.7.2015.
Aggrieved by the same, the petitioner filed the present revision case.
3. Heard and perused the material available on record.
4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the condition imposed by the trial Court in the order under revision i.e., deposit of 50% of arrears of maintenance is modified to that of 25% of arrears of maintenance. Further, the time granted by the trial Court for deposit of maintenance is extended till 31.8.2015.
5. With the above direction, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
