Heard counsel for the petitioner, Sri V.Narasimha Goud, Standing counsel for 2nd respondent and Sri N.Praveen Kumar, Sanding Counsel for 3rd respondent 2.

Petitioner had filed this Writ Petition challenging the order dt.01.09.2016 of the 2nd respondent upholding the permit dt.07.12.2015 issued in favour of the 4th respondent. 3.

In the impugned order, the 2nd respondent has stated that the petitioner had mislead the 2nd respondent stating that he had a subsisting injunction order, but the said order had been vacated on 30.08.2014 itself. On that ground the 2nd respondent has refused to accede to the petitioner's request to cancel the draft lay out permission granted to the 4th respondent.

Counsel for the petitioner states that a Revision is pending against the order vacating the injunction, but he does not dispute the fact that no injunction order has been granted in favour of the petitioner in the said Revision, which is said to be pending before this Court.

Therefore, I do not find any merit in this Writ Petition and it is accordingly dismissed with costs of Rs.1,000/- to be paid to the High Court Legal Services Committee within a period of four

(04) weeks from today.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
