THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27938 of 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home.

When the matter is taken up, written instructions dated 28.08.2017, furnished by the Station House Officer, Mallacheruvu Police Station, have been placed on record by the learned Government Pleader for Home.

According to the said instructions, the respondent-police seized the subject-auto and registered Cr.No.321/2016 under Section 7 (a) r/w 8 (e) of the A.P.Prohibition Act and, during investigation, deposited the seized property before the Deputy Commissioner of Prohibition & Excise, Nalgonda, and filed a charge sheet before the Judicial First Class Magistrate at Nalgonda vide C.C.No.985/2016.

In view of the above, the Writ Petition is disposed of, keeping it open to the petitioner to make necessary application before the appropriate authority.

As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
