THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23128 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the respondents in not releasing the petitioner's properties i.e. open plot Nos.1, 2, 4 to 10, part of 24, 25 to 40 and part of 41 of TLP No.42/2011/H in survey Nos.431/A, 432/A, 432/AA, 433/A, 433/E, 433/EE, 435/AA, 436/AA and 439 situated behind KPHB colony, Vinayak Nagar, Nizamabad, which were mortgaged with respondent-bank, as illegal and arbitrary.

Heard the learned counsel for the petitioner. Since this Court is not going into the merits of the case, there is no necessity to issue notice to respondents.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer, seeking a direction to respondents to consider the representations made by the petitioner on 29.12.2016 and 06.02.2017 respectively, seeking release of the open plots offered as collateral security, at the earliest.

Having regard to the facts and circumstances of the case and without going into the merits of the case, the Writ Petition is disposed of, at the stage of admission, directing the second respondent to deal with the representation submitted by the petitioner on 29.12.2016, seeking release of the open plots, which were offered as collateral security for the loan obtained by the petitioner from the respondent-Bank, and pass necessary orders

thereon, in accordance with law, as early as possible preferably within a period of three weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
