THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9598 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.61 of on the file of Kondapur Police Station, Jogulamba Gadwal District, registered for the offence under Sections 366, 376 (2) (n) r/w. 109 of IPC and Section 5(l) r/w. 6 and Section 16 r/w. 17 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The allegation against this petitioner is that he proposed to the victim girl who is aged less than 18 years and they moved closely. Ten months prior to the complaint, he passed on, his mobile number. Thereafter, they were in constant touch. Petitioner expressed his love for her and proposed to get married. On 01.09.2023, the
victim girl went to a temple where this petitioner took her on his bike to the house of A-2 and there he had sexual intercourse with her. On 05.09.2023, they came back to the village and she was dropped at her house. 4.
As seen from the circumstances and the remand report, the victim girl and this petitioner were having a love affair. In the said circumstances, since most part of the investigation is complete and witnesses have been examined, this Court deems it appropriate to grant the relief of regular to the petitioner, subject to following conditions:
i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate, Alampur.
ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.
iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
