THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.3325 of 2014 ORDER:
The present writ petition was filed seeking a direction to the Tahsildar, Patancheru Mandal, Medak District, not to interfere with the petitioners' possession and enjoyment over the lands in Survey No.261 of Chinnakanjerla Village, Patencheru Mandal, Medak District. On 06.02.2014, an interim order was granted directing status quo obtaining as on that day to be maintained for a period of two weeks. The said order was thereafter extended from time to time. Alleging disobedience to the said order, the petitioners filed C.C.No.434 of 2014. The said contempt case was dismissed vide order dated 27.06.2014. A copy of the said order is placed on record. Perusal of the order dated 27.06.2014 reflects that the Tahsildar, Patancheru Mandal, filed a counter affidavit in the said contempt case, stating as under:
'It is respectfully submitted that, the respondent or their staff have never entered or tries to enter/interfere into the land of the petitioners situated SY.No.261, not threatened or asked the petitioners to vacate the land situated in Sy.No.261 and damaged the property, demolished structures situated in Sy.No.261, as the respondent or his staff are no way concerned/interested for the land situated in Sy.No.261. The Executing Agency i.e., Panchayat Raj Department appointed by the District Collector, Medak have started the fencing work around the Government land situated in Sy.No.271 of Chinna Kanjarla village of Patancheru Mandal to protect the valuable Government land/Public property from the clutches of the land grabbers.' In the light of the aforestated averments made by the Tahsildar, the contempt was dismissed as it was not established that there was any disobedience to the order of status quo.
Sri T.Vijay Hanuman Singh, learned counsel for the petitioners, would inform this Court that his clients thereafter filed W.P.No.41675 of 2018 assailing the action of the revenue authorities in not issuing them pattadar pass books/title deeds in relation to the subject lands in Survey No.261 of Chinnakanjerla Village.
The said writ petition was disposed of by order dated 26.11.2018 directing the Tahsildar, Patancheru Mandal, to consider the petitioners' application dated 13.05.2018 in accordance with law within a time frame. Sri T.Vijay Hanuman Singh, learned counsel, would state that owing to the pendency of the present writ petition, the revenue authorities are not taking steps for issuance of pattadar pass books/title deeds. Learned counsel would further state that in the light of the stand taken by the Tahsildar in the contempt case, the apprehension of the petitioners that the revenue authorities would interfere with their possession stands settled.
In that view of the matter and as this Court is informed that the revenue authorities are in the process of considering the application made by the petitioners for issuance of pattadar pass books/title deeds, the writ petition is closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
