THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 26745 OF 2019 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in passing the Award and trying to pay the compensation amount in favour of the unofficial respondents 6 and 17 without considering the objections dt.23.10.2019 of the petitioners in connection with the lands in Sy.No.166/1 to an extent of Ac.0.2100 guntas and 171/1 to an extent of Ac.5.0300 guntas, total Ac.5.2700 guntas, belonging to the 1st petitioner, and land in Sy.No.166/2 to an extent of Ac.0.2100 guntas and an extent of Ac.5.2400 guntas in Sy.No.171/2, belonging to the 2nd petitioner, situated at Arlapenta Village, Dammapeta Mandalam, Bhadradri Kothagudem District.

Learned Assistant Government Pleader for Land Acquisition produced written instructions stating that the land claimed by the writ petitioners in Sy.No.166/1 & 166/2 does not fall under acquisition; and that the land claimed by the petitioners in Sy.No.171/2 to an extent of Ac.7.00 guntas is coming under acquisition. It is further stated that the objections filed by the petitioners on 23.10.2019 will be considered at the time of

preparation of publication of Declaration under Section 19(1) of Land Acquisition Act, 2013.

Since the objections filed by the petitioners are pending before the 3rd respondent and since the 3rd respondent states that the objections of the petitioners would be considered at the time of publication of declaration under Section 19(1) of the Land Acquisition Act, 2013, the writ petition is disposed of directing the 3rd respondent to consider the objections of the petitioners before publication of declaration under Section 19(1) of the Land Acquisition Act. If petitioners are still aggrieved by the decision taken by the 3rd respondent, it is open for them to challenge the same, in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
