P.Prem Kumar, S/O. Dr. P. Sreenivasa Rao, v. Central Board Of Secondary Education, Rep.By Its Joint
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION No. 7584 of 2017 ORDER: (Per VRS,J) The petitioner, who did not satisfy the eligibility criteria in terms of age for participating in the National Eligibility-cum-Entrance Test-2017, has come up with the present writ petition. 2.
Heard Mr. V. Maheswar Reddy, learned counsel for the petitioner.
3.
The admitted date of birth of the petitioner is 16.03.2001. As per the eligibility criteria for taking NEET-2017, the candidate must have completed 17 years of age at the time of admission or will complete the age on or before 31.12.2017. The petitioner will be completing 17 years of age only by 16.03.2018. Therefore, his application was not rightly entertained.
4.
In any case, though we have passed a few interim orders in other cases, those cases came up before us before the last date for submission of applications, namely, 01.03.2017. Though the petitioner came early into the world to seek admission for the next academic year, he has come belatedly to the Court to seek admission for the current academic year. Therefore, no relief can be granted to
him even on sympathetic grounds. Hence, the Writ Petition is dismissed.
Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J ______________ J. UMA DEVI, J.
