HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.16163 of 2017 ORDER:

The only grievance of the petitioner in the present writ petition is that without due process of law, the respondents herein are taking action for installation of 400 KV Tower (Tower No. 41/10) in the agricultural land of the petitioner in Survey Nos.747, 749, 750 & 752, situated at Kandi Village & Mandal, Sanga Reddy District.

Heard the learned counsel for the petitioner, Sri R. Vinod Reddy, learned Standing Counsel appearing for respondents 1 to 4 and the learned Government Pleader for Revenue appearing for respondents 5 & 6.

When the matter is taken up, on instructions, it is submitted by Sri R. Vinod Reddy, learned Standing Counsel for the respondent organisation that the tower of 400 KV has already been installed and only one leg of the said tower happens to be in the land of the petitioner herein and the other three legs of the tower are situated in the lands of the three neighbouring ryots and that they have already received the compensation as per law and the respondents are ready to pay the compensation to the petitioner herein also.

The said submission is recorded.

Accordingly, the Writ Petition is disposed of keeping it open to the petitioner herein to submit an application to the

AVSS,J W.P.No.16163 of 2017 respondents requesting them for payment of compensation and if any such application is made, the same shall be considered and appropriate orders be passed, in accordance with law. The respondents are at liberty to proceed with the proposed work. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
