THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY WRIT PETITION No.31633 OF 2021 ORDER:

This writ petition is filed with a prayer to direct the respondents more particularly respondent Nos.3 and 4 to extend the benefit provided under NABARD Ref No. NB/ PCDOPR/ 11383/A-10 Special Package 2006-07 Circular No NB172/PCD/15, dated 19.10.2006, to the petitioner and consequently direct the respondents not to attach the properties of the petitioner in the interest of justice and for other appropriate orders.

The petitioner claims to be an agriculturist and also doing poultry business and he is entitled for the benefit sanctioned by NABARD under various circulars. The petitioner also refers to the circular issued by respondent No.6 vide Ref No. NB/ PCD(OPR)/11383/A-10 (Special Package) 2006-07 Circular No. NB172/PCD/15, dated 19.10.2006, for releasing benefits to the small farmers.

The grievance of the petitioner is that even though he is entitled for the benefits under the above said circular issued by respondent No.6, respondent Nos.4 is not considering his case for releasing the benefits as per the above circular issued by NABARD.

Sri Guru Prasad, learned Standing Counsel appearing for respondent No.4 vehemently contended that the petitioner is not a small farmer and he owns large extent of land and he is not entitled for the benefits given to small farmers under circular issued by respondent No.6.

Learned Assistant Government Pleader for Agriculture submitted that if the petitioner is a small farmer, he can make an appropriate application to respondent Nos.5 and 6 duly submitting the passbooks issued by the State Government and also the Dharani Portal records to enable him to avail the benefits.

Therefore, this writ petition is disposed of directing the petitioner to make suitable representation duly enclosing the relevant documents and the same shall be considered by respondent Nos.4 and 6, strictly in accordance with the circular instructions issued by respondent No.6-NABARD within a period of six (6) weeks from the date of receipt of a copy of this order and if the petitioner is not entitled for the benefits, respondent Nos.4 and 6 are directed to pass appropriate orders on merits and communicate the orders thereon within the aforesaid period. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
