N. Rajeshwar Rao .. Petitioner and The Managing Director & Vice Chairman, A.P.S.R.T.C., Musheerabad, Hyderabad and others .. Respondents
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.3612 OF 2007
O R D E R
The grievance of the petitioner in this case was that the Andhra Pradesh State Road Transport Corporation (APSRTC) sought to retire him from service forcibly on medical grounds without providing him alternative employment in accordance with law. By order dated 23.02.2007, this Court directed the APSRTC to consider the case of the petitioner for alternative employment as per Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. The Law Officer of the APSRTC, Musheerabad, Hyderabad, filed a counter-affidavit stating that pursuant to the interim order, the petitioner was provided alternative employment as a Shramik at Metpalli Depot, Karimnagar District, under proceedings dated 24.04.2007. She further stated that the petitioner had reported for duty as a Shramik and was given the grade of pay equivalent to that of a HMV driver. She further stated that he was working at Godavarikhani Depot and asserted that the relief had already been granted and that the writ petition is liable to be dismissed.
In the light of the aforestated developments pursuant to the interim order, this Court is of the opinion that no further adjudication is called for in this writ petition which is accordingly closed. Pending miscellaneous petitions shall also stand closed. No order as to costs. ______________________ SANJAY KUMAR, J
