THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.27631 of 2009 ORDER:

The relief sought for in this writ petition is to declare the demand notice issued by the 2nd respondent-Bank as contrary to Clause (4) of the Agriculture Debt Waiver and Debt Relief Scheme, 2008. Sri V.Raghu, learned Standing Counsel for the 2nd respondentBank, on instructions, states that the petitioner's loan account has since been closed.

Smt. G.Kavitha, learned counsel for the petitioner, would submit that, in the light of the submission of the learned Standing Counsel, the cause in the writ petition does not survive.

Recording the submission of Sri V.Raghu, learned Standing Counsel, that the petitioner's account has since been closed, and as the cause in the writ petition does not, therefore, survive, the Writ Petition is dismissed as infructuous.
