HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 24109 of 2015 ORDER:

Heard learned counsel for the petitioner and learned standing counsel for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself. The present writ petition is filed seeking issuance of a writ of mandamus directing the respondents to consider and dispose of the representation dated 03.06.2015 made by the petitioner for rectification of his date of birth in their service register as 05.06.1962 instead of 05.01.1958.

The grievance of the petitioner is that though he made a representation dated 03.06.2015 to the 2nd respondent seeking rectification of his date of birth as 05.06.1962 instead of 05.01.1958, till date no orders are passed on the said representation. Learned counsel for the petitioner submits that the date of birth of elder brother of the petitioner, who has been working in the respondent company, is recorded in the service register as 05.06.1960, and as such, the date of birth of the petitioner cannot be 05.01.1958 and the same has to be rectified as 05.06.1962. He further submits that similar representations made by some of the employees have been considered by the respondent company. Having regard to the circumstances stated above and without going into the merits of the case, the respondents are directed to consider and dispose of the representation dated 03.06.2015 made by the petitioner and determine his date of birth as per rules and also by taking into consideration the date of birth of his elder brother, by name

Debbati Mallaiah, who also works in the respondent company, within a period of eight (8) weeks from the date of receipt of a copy of the order. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any in the writ petition shall stand closed.
