HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23413 of 2018 ORDER:

Heard Mr.P.Ananth Nageswar Rao for petitioners and the learned Assistant Government Pleader for Revenue. Aggrieved by the order dated 23.06.2018 passed by the 3rd respondent, the present writ petition is filed. I have taken note of all the dates namely date of disposal of W.P.No.17010 of 2018 and the order of the 3rd respondent. It is not the case of petitioner that the petitioner has brought to the notice of the 3rd respondent, the order passed by this Court in W.P.No.17010 of 2018. Now, the petitioner cannot take advantage of a decision taken by the 3rd respondent and the appeal is a substantive remedy in cases like this. Therefore, the petitioners are relegated to the remedy of appeal against the order impugned in the writ petition.

Hence, the writ petition is disposed of by this order. (a) The petitioners are given liberty to file appeal within four weeks from today by enclosing a copy of this order.

(b) The proceedings impugned in the writ petition are suspended for a period of twelve weeks from today.

(c) The petitioners are given liberty to take further orders as are necessary from the appellate authority.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
