THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34022 of 2017 ORDER:

The petitioners claim to be the Ward Members of the sixth respondent Gram Panchayat, Nandavaram Village and Mandal, Kurnool District. The seventh respondent is stated to be an elected President of the Gram Panchayat. It is their case that the seventh respondent is conducting the affairs without having regard to the provisions of the Andhra Pradesh Panchayat Raj Act and the Rules framed thereunder. They state that there are sixteen Ward Members and the petitioners are nine in number. They state that even though they brought it to the notice of respondent Nos.2 to 5 with regard to the irregularities alleged to have been committed by respondent Nos.6 and 7, when no action was taken, the present Writ Petition is filed. Admittedly, the seventh respondent is the President of the Gram Panchayat and he is an elected President.

If the majority of the Members of the Gram Panchayat feel that the seventh respondent is acting against the interest of the Gram Panchayat and the provisions of the Andhra Pradesh Panchayat Raj Act, they can take appropriate action under the provisions of the Andhra Pradesh Panchayat Raj Act. The present Writ Petition is not a proper remedy and this Court cannot investigate into the affairs of the Gram Panchayat and more particularly the conduct of respondent Nos.6 and 7 in the Writ Petition.

In the circumstances, the Writ Petition is dismissed giving liberty to the petitioners to agitate their matter before appropriate forum. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
