THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42520 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent No.2 in granting legal protection to protect the House hold property of the petitioner as per complaint dated 29-12-2015 against the respondents No.3 to 5 who are accused in Crime No.399 of 2015 of the 2nd respondent Police Station is arbitrary and illegal, against the principles of Natural Justice and violative of Article 14 and 21 of Constitution of India and consequently issue a direction to the respondent No.2 to grant Police aid to the petitioner against unofficial respondents as per law and to pass such other order or orders appropriate in the case." 2.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that basing on a complaint, dated 29.12.2015, made by him against respondent Nos.3 to 5, respondent No.2 registered a case in Crime No.399 of 2015 for the offences punishable under Sections 447 and 506 I.P.C., but he is not providing police protection to him basing on the said complaint and hence, prays to give a direction to respondent No.2 to provide police aid to him against respondent Nos.3 to 5.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, respondent No.2 is hereby directed to consider the complaint, dated 29.12.2015, of the petitioner regarding providing of police protection to the petitioner and pass appropriate orders in

accordance with law as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
