HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17152 OF 2016 O R D E R :

The case of the petitioner is that it is an agency registered under the partnership Act vide Regd.No.13/2008 in the name of M/s. Manpower Servicing Agencies which supplies the manpower to the Government hospitals in Krishna District on yearly contract basis for the purpose of sanitation work. In pursuance to the tender notification issued by the 4th respondent for contract period of one year i.e., 01.06.2015 to 31.05.2016, the petitioner was selected and has successfully completed contract period work to the respondent No.5 hospital. Though the contract period is over, the petitioner agency continued its services to respondent No.5 hospital. Thereafter, the petitioner made a representation dated 22.04.2016 to respondent Nos.1 to 4 as per clause 8 of G.O.Ms.No.99, dated 05.05.2010 requesting for extension of contract period. But till today, the petitioner's request for extension of contract period has not been considered by the respondent Nos.1 to 4. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that this Court in similar circumstances directed the respondent authorities to dispose of the representations filed by the petitioners as per law. On the other hand, learned Standing counsel for respondent Nos.3 and 4 submits that since the contract period is over, the respondents are contemplating to go for fresh tender. He also submits that there are allegations against the petitioner agency. He further submits that in the present case, the respondent authorities have already taken a decision to go for fresh tenders.

Since it is for the respondent authorities to dispose of the representation filed by the petitioner, there shall be a direction to the 4th respondent to dispose of the representation filed by the petitioner in accordance with law and if the respondents have already taken a decision

to for fresh tender, it is for them to take a decision in this matter. This Court has not expressed any opinion on merits. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
