Kuka Ravi v. The State Of Telangana

This is an application filed under Sections 437 and 439 Cr.P.C. for bail by the petitioners-A1 to A3 in Crime No.315 of 2015 of Medipally Police Station, Cyberabad, registered for the offences punishable under Sections 376 (d) I.P.C of Criminal Amendment Act, 2013, 109 I.P.C. and Section 5 (g) of Protection of Children from Sexual Offences Act, 2012.
It is alleged by the prosecution that on 20.05.2015 at 8.00 A.M. the victim girl N.Ratna Kumari, aged about 16 years, had borrowed her mother's mobile phone and gone to Gayatri college, Habsiguda and at about 1.00 P.M. she received a call from the 1st petitioner-A1 and that she left the college and met A-1. It is further alleged that the victim girl and the 1st petitioner-A1 went to Boduppal to the house of A-4 and after some time A-2 and A-3 also came there. It is further alleged that A-1 committed rape on the victim girl and thereafter A-2 and A-3 committed rape on her one by one and that they all threatened her to kill if she informs the matter to anybody. Learned Counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence and a false case has been foisted against them and that the petitioners are in judicial custody since 29.05.2015.
Learned Public Prosecutor representing the State submitted that the investigation is not yet completed and if the petitioners are released on bail, they will tamper the witnesses.
In view of the serious allegations levelled against the petitioners and the nature of offence alleged to have committed, it is not a fit case where the petitioners can be enlarged on bail at this stage.
