THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3346 OF 2016 ORDER:

This Criminal Petition is filed by the accused No.1 & A.2 under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.346 of 2015 pending on the file of III Metropolitan Magistrate, Cyberabad at Kukatpally for the offences under Section 138 of Negotiable Instruments Act.

The points now raised by the learned counsel for the petitioners for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated and decided on merits by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings at this stage.

In the result, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
