When the matter was called on 23.09.2016, there was no representation for the appellant and, therefore, the matter was directed to be listed today under the caption "For Dismissal". Today also, despite listing the matter under the caption "For Dismissal", neither the appellant is present nor is there any representation made on his behalf.

The Second Appeal is, accordingly, dismissed for nonprosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal, shall stand dismissed.
