HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.7193 OF 2014 ORDER:
Heard learned counsel for the petitioners and the standing counsel. The petitioners pray for Mandamus declaring the land acquisition proceedings in File No.C3/354/2013 concerning premises bearing No.8-2293/82/1/227 and the Award dated 27.12.2013 in F.No.C3/354/2013 as being illegal and contrary to Section 49 of the Land Acquisition Act, 1894 (for short 'the Act') and the petitioners pray for the alternative relief to direct the respondents to acquire the left over property of properties in Premises No.8-2-293/82/1/227 in the interest of justice.
The respondents acquired an extent of 597.62 square yards through the Award dated 27.12.2013. Prior to passing of the Award, the petitioners represented to the respondents under the scheme of the Act to acquire the balance extent of 358 square yards and as balance extent is not useful to them for any other purpose. At the time of hearing, the learned standing counsel, Sri Vivek Reddy, on instructions, submits that the respondents while accepting the position stated in the Award dated 27.12.2013, are proceeding to acquire the balance extent of 358 square yards covered by Premises No. 8-2-293/82/1/227 in accordance with law and pay compensation to the petitioners.
The statement of learned standing counsel is placed on record. As the alternative prayer of petitioners is substantially accepted by the respondents, the writ petition is disposed of by placing the statement on record. No order as to costs.
