HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.26758 of 2019 ORDER:

This writ petition is filed with the following prayer: "It is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the inaction of the 2nd respondent in releasing the petitioner's vehicle make of Ashok Leyland Dost bearing No.TS 08UA-2909 which was seized in relation to C.O.R No.119 of 2019 on the file of the 3rd respondent in spite the petitioner ready to furnish third party security as illegal, arbitrary and consequently direct the 2nd respondent to release the petitioner's vehicle i.e., Ashok Leyland Dost bearing No. TS 08 UA 2909 and pass such other order or orders this Hon'ble Court may deem fit and proper in the circumstances in the case."

It is stated by the learned counsel for the petitioner that the lis in this Writ Petition is squarely covered by the orders of this Court dated 18.11.2019 in WP No.24990 of 2019 and same is not disputed by the learned Assistant Government Pleader for Prohibition & Excise.

Since the petitioner has not made any application before the 2nd respondent-Deputy Commissioner of Prohibition and Excise, Saroornagar, R.R.District, liberty is granted to the petitioner to make an application before the 2nd respondent for release of the vehicle. Upon filing of such application by the petitioner, the 2nd respondent shall consider and pass orders on the same for release of the vehicle, subject to providing security for the value of said vehicle as valued by the Motor Vehicle Inspector, within a period of two weeks.

3. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed. _________________________ A.RAJASHEKER REDDY, J 04-12-2019 kvs
